SHANTI Act opens nuclear power to licensed Indian companies; FDI still barred

The SHANTI Act 2025 received assent on 21 December 2025, allowing licensed government and Indian-incorporated companies to build nuclear plants. FDI in atomic energy remains prohibited.

What changed

The SHANTI Act 2025 licenses government entities and Indian-incorporated companies to take part in nuclear power, subject to AERB safety authorisation. FDI in atomic energy is still prohibited under the RBI Master Direction of June 2026. An FDI policy approved by the Atomic Energy Commission was in inter-ministerial consultation in April 2026.

What to do

Do not plan equity investment in nuclear generation yet. Track the FDI policy under consultation, and look at supply or technology roles that do not require equity.
